Definitions

Any sale or purchase is entered into with House of Gillani Limited (‘’we’’, ‘’us’’ ’’our’’).

‘Products’ are any House of Gillani products.

‘You’ or ‘Your’ means the customer.

‘Conditions’ means the terms and conditions.

‘Non-exhaustive’ means a list that is not necessarily exhaustive or complete.

‘Days’ shall be counted as working days excluding weekends, public and religious holidays.

Introduction

House of Gillani Limited is an active Private Limited Company which is registered in England and Wales. We are registered under the number 14381525 under Companies House with our registered address 276 alum rock road, Birmingham B8 3DD. The products listed on our website are directly sold by House of Gillani Limited, therefore, the contract that you enter will be with House of Gillani Limited. The website and all relevant intellectual property and trademark rights are the property of House of Gillani limited. In purchase of our products, the following terms apply. House of Gillani complies with the statutory requirements and rights as set out under the Consumer Rights Act 2015. This includes, but is not limited to, goods to be of satisfactory quality, as described and matching samples or models seen. 

 

To shop with House of Gillani we request that our customers:

  • Be at least 18 years of age at the time of purchase;
  • Have a valid debit or credit card and have authorisation to make purchases with said card;
  • You can only place an order for a House of Gillani product if you are a consumer. We are unable to supply our products to other businesses;
  • Acknowledge that your order is subject to English law and that any dispute or claim will be made in the exclusive jurisdiction of the English courts;
  • Acknowledge that these terms and conditions apply and are subject to change by us at any time.


 

Prices/Payment

All product prices are given in British Pounds and are inclusive of UK value added tax (‘’VAT’’). Product prices are subject to change, the final price will be stated in checkout.  We endeavour to ensure that all product descriptions and prices are correct. In the event of an error, we are under no obligation to complete your order under the incorrect price. In this event, we may contact you and offer the product at the correct price. House of Gillani can alter the price of any product at any time. No change to the price of a product will be made after you have successfully placed an order with us. You confirm to us that you are authorised to make purchases using the credit/debit card for the details that you enter. If your payment is unable to be successfully completed or there has been a failure in card authorisation (by the card holder or issuer) we reserve the right to cancel your order. Payments can be accepted through the methods of Visa, Visa Debit, MasterCard, Mastercard Debit, American Express, Visa Delta, Electron and PayPal. If there is a promotion or special offer, the specific terms of the relevant promotion/offer will be stated upon our website and should be used at checkout. Only a single promotion or special offer is able to use at a time and is constrained by relevant dates or times.

 

Placing an order

The products and prices listed upon our website do not constitute the legal requirements for an offer, it is an invitation to treat and should be treated as such. To successfully complete a purchase from the House of Gillani website we require that these terms and conditions be accepted. Our privacy policy can also be found on our website. Please ensure that all information in checkout is accurate when placing an order.  You are entitled to browse our website without registration. However, to complete an order, you must register an account with us. This includes providing us with an email address and password. Please ensure that you do not give anyone your password, and that you notify us immediately (at info@houseofgillani.co.uk) if there is any unauthorised use of your account. House of Gillani reserves the right to not accept an order once an order has been placed. Please wait for a communication from House of Gilani which indicates acceptance once you have placed an order. Once this communication of acceptance has been received, you are unable to cancel or modify your order unless you are seeking to return or refund your product (see below).

A non-exhaustive list of reasons why we may not accept an order:

  1. Our inability to fulfil an order, due to stock/manufacturing/tailoring capacity issues.
  2. An issue with receiving payment for products.
  3. An incorrect price placed on the website.
  4. We are unable to deliver to your address.
  5. There are suspected unauthorised activities.

 

Upon the successful completion of the ordering process, we will send an electronic invoice to our customer. The information presented on the invoice is unable to be changed. For any issues with your invoice, please contact info@houseofgillani.co.uk.

 

Returns and Refunds

We hope that our customers are satisfied with their experience shopping with House of Gillani. If you are not wholly content with your purchase, you are entitled to a full refund and a return of the product subject to the terms and conditions. However, certain products are exempted from this.

For any return that is wished to be made, please contact info@houseofgillani.com. We will then be in touch with the return address and complete process of delivery (subject to our terms and conditions). All items which our customers wish to return are expected to be in their original condition, with all relevant packaging and tags. All items will be inspected upon return, and if the condition of the item is deemed unsatisfactory, we will not be able to complete a refund. If your refund has been refused and you would like to know why or contest this, please reach us at info@houseofgillani.com. In the event of our rejection of a refund, the product will be sent back to the address of original delivery and receipt. House of Gillani endeavours for this to be accomplished within 30 days of us notifying our customer of the rejection of the returned product.

 

We request that all customers return their item to us within 14 days of you notifying us of your decision to return/refund your item. We will refund the relevant amount to you within 14 days of the item being received by House of Gillani. All refunds will be made to the card used when making the original payment. We are unable to make the refund to any other credit/debit card.

 

Made to Order Items

House of Gillani, as a luxury brand, operates a made to order service. This allows you to personalise our house styles with your choice of fabric and sizing. For an item that has been made to specific measurements you are entitled to exchange or refund the item within 14 days of the item being delivered to you. This is on the condition that the product is unused, and undamaged. The consumer must cover the relevant cost of shipping. If a customer requests a refund outside of the stated time above, any refund will be at the discretion of House of Gillani Limited.

 

Custom Items

Any custom item that has been manufactured or altered to fit the specifications or requests of our consumers is ineligible for a return or refund. This includes items personalised in any way; made to your measurements or monogrammed products. Once the payment has been successfully received by House of Gillani Limited, we are unable to cancel or refund the relevant order. We will only offer a refund in the event of a fault with the item.

 

Delayed/Damaged Items

In the event of an item that is delayed or damaged, please contact us at info@houeseofgillani.co.uk. For a damaged item to be returned and a partial or full refund be rewarded, we request proof (in the form of photographs) within 48 hours of the item being delivered to the customer. For custom items please get in contact with us as each product will be judged on a case-by-case basis.

 

Manufacturing Defect(s)

In the event of a manufacturing defect, any request for exchange or repair should be made through contacting us at info@houseofgillani.co.uk

During the relevant and expected lifespan of your product you are entitled, through the Consumer Rights Act 2015, to:

  1. If a product is deemed to be faulty, the consumer is entitled to an immediate refund following 30 days of the delivery
  2. If your product is unable to be repaired or replaced, then you are entitled to a refund up to 6 months following delivery

In the event of damage caused by the customer, including any alteration or modification of the product, House of Gillani does not accept responsibility for any damage. For example, this includes normal wear and tear, improper use, or unsatisfactory maintenance. In the event of your goods being faulty, we are only able to replace the item for the same product in the same size as ordered (subject to availability).

 

Shipping Policy

All relevant shipping costs from House of Gillani Limited to our customers are free. We aim to have all orders within the United Kingdom delivered within a maximum of twenty-eight (28) working days following successful receipt of payment by House of Gillani and our acceptance of your order. 

Please note that custom items may take longer, and its date of delivery will be at the discretion of House of Gillani. 

 

Products will only be sent out for delivery once House of Gillani receives full payment for the relevant product(s). Any failure to receive full payment allows House of Gillani to refuse to dispatch the relevant item. All deliveries will be made to the address indicated to us by the consumer on checkout. We refuse any responsibility for an incorrect delivery address given to House of Gillani. Please note that we are unable to deliver to PO boxes. If there is any issue with the delivery of the product, we will aim to get in contact with you within 24 hours of dispatch. In this situation, if your product arrives after the stated twenty eight (28) working days, we will NOT accept a refund claim in relation to a delay in delivery. We do not take responsibility for parcels that have been lost because of instructions given to the courier independently by our customers. In times of busy periods (such as Eid Al-Fitr and Eid Al-Adha) deliveries may take longer. Also force majeure events such as weather conditions may result in delays in delivery without any liability to you.

 

Following the successful delivery of the product, customers (or the designated individual for receipt of the product) should ensure that the product corresponds with the relevant order. This includes but is not limited to:

  1. The condition of the item (including packaging and product). For example, rips, scratches, or missing buttons. 
  2. The item corresponds to the order totally. This includes colour, size, and item type. 

 

We ask that all customers comply with the courier’s request for signature or ID on receipt of delivery. House of Gillani does not take any responsibility for incompletion of delivery because of your failure to comply with (any of) the relevant requests made by our courier service for the successful completion of delivery. Our customers should acknowledge that legal title passes to you on successful delivery to the address provided. Alongside this, the relevant risks of damage to the products passes once our consumers have received the item at the designated delivery address.

If there are any changes to your details that you would like to inform us about, please get in contact with us at info@houeseofgillani.co.uk or update your account independently.

 

Amendments to the Terms and Conditions

At House of Gillani, we hold the right to amend these terms and conditions in any way and at any time. All amendments will take effect once the change has been updated on our website. It is the responsibility of the customer to make themselves aware of our terms and conditions on each occasion that you use our website. Included within our right to amend these terms and conditions is our right to alter our privacy policy (also available on our website). 

 

Liability, representations, and warranties

There is nothing in these terms and conditions which exclude our liability in the event of death or personal injury because of our negligence or fraud. We take safeguards to ensure that all payment details that have been provided are securely protected. In the event of economic losses because of unauthorised access to this information, we cannot be held liable for these losses. Moreover, we refuse to be liable for economic losses or indirect losses that have arisen because of your contract with us. We are not liable for damage or loss that would have been reasonably foreseeable at the time of purchase, or at the time of your acceptance of general terms. Any representation or warranty made on a 3rd party or linked website is wholly independent from House of Gillani. We do not accept responsibility for relevant content or representations made on linked websites or liability for any losses that may occur as a result using any other website than ours.

 

Indemnity

Our customers agree to indemnify and hold harmless the directors, officers, consultants, agents, and employees of House of Gillani from any third-party claims, damages (including legal fees) which have arisen from a breach of the terms of services or use of the website.
